U.S. Says It May Not Need Apple’s Help to Unlock iPhone

The Justice Department moved to cancel a Tuesday court hearing in its bid to gain access to phone data in the San Bernardino mass shooting inquiry. NYT

 

Were I the lawyer for Apple in this, I would consider filing a motion asking the court to award me my costs, in light of the fact that it turns out that the government’s motion was unnecessary. Then the government would have to explain in some detail the reason for its retreat, unless the government is willing to eat crow. ~ Harvey Silverglate

 

I suspect this is what is known as a strategic retreat. The last thing the Justice Department wants is a decision against them on this question in the record. ~ Chuck McManis
